Template: Seeking information about a partner’s AI deals

This is a template letter that you can use when seeking information about any AI deals that your business partners have entered into.

Obviously you should edit it according to your needs and situation, and insert the necessary company names where required.

There is further guidance for when you are discussing AI deals with rightsholders here.

Thank you for the information you have sent about your licensing deal with [INSERT COMPANY NAME]

OR

I have read in the trade press about your deal with [INSERT COMPANY NAME]

I want to thank you for pursuing opportunities in the AI space on our behalf and for your work helping to ensure AI companies respect the rights of both creators and rightsholders.

Just to be clear, I do not consent on a general basis for my music, lyrics, voice, likeness or name to be used by any AI platforms, for either training models or on the outputs of AI platforms.

I expect all rightsholders in the music industry to fulfil their legal and moral obligations to secure music-maker consent before allowing any individual music-maker’s works and rights to be included in any AI deals.

I am happy to consider each individual AI opportunity you have identified and negotiated.

In order to do so, I require some information about the deal and how it will work. I’d therefore be grateful if you could provide the following information as a minimum.

  1. Are you receiving a lump sum payment from [INSERT COMPANY NAME] and/or a share of future revenue? How is this being calculated?
  1. How will the money you receive be allocated to individual works?
  1. What royalty rate do you plan to apply to this income stream?
  1. Can I opt-in on a work-by-work basis?
  1. Are you receiving a legal settlement payment, an advance and/or equity as part of the deal? If so, how do you plan to share this with music-makers?
  1. Will my income from these deals be set off against unrecouped balances?

[IF YOU ARE EMAILING A LABEL]

  1. How will the publishing be handled? Will recording rights and song rights be treated and valued equally in this deal?

[IF YOU ARE EMAILING A PUBLISHER]

  1. Will there be additional PRS income due on this deal?
